What You Need to Know After a DWI Arrest


Driver’s License

You have 15 days from the date of your arrest to request a hearing — otherwise, you automatically lose your license.

If You Took the Test (“Blew”):

  • 1st Offense: Up to 30 days license suspension

  • 2nd Offense: May require ignition interlock to be reinstated and face a one year license revocation (if last offense within 5 years) or a 90 day suspension (prior offense outside of 5 years)

  • 3rd+ Offense: Possible 10-year license loss with ignition interlock

If You Refused the Test:

  • Automatic 1-year license revoked if no hearing is requested

Limited Driving Privilege

  • You may be require to complete certain tasks to be eligible for Limited Driving Privilege.

CRIMINAL CHARGES

The state or city has up to one year (misdemeanor charges) or three years (felony charge) to file charges, which vary depending on your record:

1st Offense:

  • Class B Misdemeanor

    • Up to 6 months in jail

    • Up to 2 years of probation*

2nd Offense (within 5 years):

  • Class A Misdemeanor

    • Up to 1 year in jail

    • Up to 2 years of probation*

3rd+ Offense:

  • Felony

    • May face prison time, Treatment Court, and/or 5 years of probation* supervised by Missouri Probation and Parole

*Probation may include community service, treatment programs, and fines or court costs.
